The Plaintiff WILLIAM BARNES, III., sues Defendants and alleges:

  2. Plaintiff and Defendants are tenants in common with their respective interest more particularly set forth in Count I.

Selective debris removal and land clearing of an approximately 700 LF x 10FT wide trail path from Blue Springs Park to Shangri La Spring including the removal of various trees, tree stumps, downed trees, shrubbery, and other vegetative debris. Additionally, the project includes the clearing of submerged vegetative debris in and around the Shangri La spring vent as well as the removal of various dilapidated structures near the Shangri La Spring site.

City of Graceville Sanitary Sewer
Collection System Lining Project:
The City of Graceville has been awarded $4,441,751.00 of Community Development Block Grant – Disaster Recovery (CDBG-DR) funding to address infiltration and inflow of storm water in the City’s Sanitary Sewer Collection System. During the events of Hurricane Michael, the increase in stormwater entering the sanitary sewer collection system as a result of infiltration due to sanitary sewer failing pipe joints and leaking manholes overwhelmed the City’s Sanitary Sewer Collection System and Treatment Plant. In the days immediately following the storm, the City experienced a 42.6% increase in effluent passing through the System which caused the City to exceed its allowable permitted inflow and treatment capacity. The excessive increase in effluent strained the already aging system. The inundation of stormwater caused pipe joints to destabilize, and inflow and infiltration entered the sanitary sewer collection system through the unstable joints, detached lateral piping, leaking manholes, resulting in failing street pavement. When the stormwater overwhelmed the system, the City experienced raw sewage backup and further damage to the sanitary sewer collection system lines.
This project will make Sanitary Sewer Line point repairs and seal up to 200 deficient Sanitary Sewer Laterals, and line or replace up to 100 deficient manholes. The City identified these laterals and manholes as breaches in the system using smoke testing and CCTV review. These repairs will increase the City’s resiliency in future storm events by reducing the increase of effluent and reducing the rise of system failure.
A portion of the City’s proposed Sanitary Sewer Lining Project may be carried out in up to 551.42 acres of the 100-year-floodplain and may be within up to 340.69 acres of wetland. Some of the proposed sanitary sewer collection system repairs may be carried out within floodplain Zones AE and A. The proposed project will make improvements to the existing sanitary sewer collection system.
The improvements will include sanitary sewer line point repairs and seal up to 200 deficient sanitary sewer laterals, and line or replace up to 100 deficient manholes in the project area. The City of Graceville does not anticipate any additional impervious areas will be created by the proposed activities in the 100-year floodplain and wetland areas.
The City of Graceville has evaluated and considered the potential options for completing this project outside the wetlands and/or the 100-year floodplain and determined that due to the fact the entire project involves upgrades to the existing components of the sanitary sewer collection system, no new lines will be installed and no new components will be added, there is no possible or financially feasible way to relocate the sanitary sewer collection system lines and manholes outside of the floodplains and/or wetlands in the project area.
The City of Graceville considered removing the sanitary sewer collection system entirely. However, the existing residential housing units and commercial businesses located in the service area are required to be served by sanitary sewer and there is no other feasible place to rehabilitate the sanitary sewer collection system except within the existing floodplain and/or wetland.
Finally, the City considered the option of simply not moving forward with the project. This option would allow the inflow and infiltration currently entering the sanitary sewer collection system to continue resulting in future pipe failures, resulting potholes and excessive effluent flows during significant storm events entering the wastewater treatment plant increasing the possibility of the failure of the wastewater treatment plant failing and ceasing to operate.
The City concluded while a portion of the proposed project may be caried out in the 100-year floodplain and/or in a wetland, the best approach to addressing the access needs of the community, is to make improvements to the existing sanitary sewer collection system infrastructure as initially proposed. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 and or 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.
Although a portion of the proposed project may be carried out in a floodplain and/or wetland, the City of Graceville believes that the current location of the proposed improvements cannot be undertaken in any other location due to the need for the sanitary sewer collection system to provide the residents in the Service Area with acceptable sanitary sewer disposal. There is, therefore, no practicable alternative than to continue with the project as proposed.
The proposed improvements conform to applicable floodplain and wetlands protection standards. The proposed action will not affect natural or beneficial floodplain and/or wetland values, and residents of the community will benefit from the project.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and/or wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplains and/or wetlands, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. Sewer Lines Hardening Project
The City of Cottondale has been awarded One Million Four Hundred Ninety-Nine Two Hundred Twenty-Eight Dollars and Zero Cents ($1,499,228.00) for the Northwest Sanitary Sewer Lines Hardening Project. During Hurricane Michael, the sanitary sewer lines, manholes and lift station comprising the Northwest Cottondale sanitary sewer collection system suffered direct damage and in combination with the age of the infrastructure, resulted in significant inflow and infiltration (I & I). The significant amount of rainfall resulting from Hurricane Michael saturated the ground surrounding these sanitary sewer lines resulting in pipe joint damage and pipe joint degradation, resulting in ground water, sand, and debris to leak into the system and wastewater/sewage to leak out. One lift station in the area was forced to greatly exceed its pumping capacity, due to the infiltration from the excessive rainfall and the presence of sand and other debris, and now is prematurely at the end of its useful life.
The City of Cottondale’s proposed project will replace 3,550 LF of existing sanitary sewer lines, rehabilitate 1,500 LF of existing sanitary sewer lines, rehabilitate one (1) existing sanitary sewer lift station, including the installation of one (1) emergency electrical generator. The project additionally will replace 16 existing sanitary sewer manholes, rehabilitate six (6) existing sanitary sewer manholes, reconnect laterals, and replace approximately 6,650 square yards of existing paving along West Street, Front Street, McKinnon Street, McClain Street, North Street, and Adams Street in the Northwest section of the City of Cottondale.
The proposed project area is located in the northwest section of the City and is bound on the east by West Street, on the south by Front Street, on the north by North Street and on the west by Parrish Street.
A portion of the construction may be carried out within approximately 2.65 acres of land located within a Flood Zone A floodplain and is not within a wetland.

REQUEST FOR RELEASE OF FUNDS
On or about March 20, 2024, the Jackson County Board of County Commissioners (County) will submit a request to the Florida Department of Commerce (FC) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to mitigate severe weather impacts that cause threats to the health and safety of first responders during the event of an emergency, by constructing a resiliency hub/safe room inside the new Jackson County Sheriff’s Office (JCSO) and completing upgrades to vital emergency communications equipment. The estimated total cost of the project is $4,902,325.18 with $4,795,365.18 in HUD funds and $106,960.00 in pledged local funds for permitting, design, and engineering fees; FC agreement #MT151.
FINDING OF NO SIGNIFICANT IMPACT
The County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Jackson County Administration Building, located 2864 Madison Street, Marianna, FL and may be examined or copied weekdays 9:00 A.M to 3:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the County. All comments must be received March 18, 2024. Comments will be considered prior to the County requesting a release of funds. Comments should specify which notice they are addressing.
RELEASE OF FUNDS
The County certifies to the Florida Department of Commerce and HUD that Wilanne Daniels in her capacity as County Administrator consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County to use the CDBG funds.
OBJECTIONS TO RELEASE OF FUNDS
FC will accept objections to its release of funds and the County certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County; (b) the County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
