First Public Hearing Notice

The City of Marianna (City) is considering applying to the Florida Department of Commerce for a FFY 2022 and/or 2023 Small Cities Community Development Block Grant (CDBG). The city is eligible to apply for up to $700,000 in the Neighborhood Revitalization, Commercial Revitalization, and Housing Rehabilitation categories and up to $1,500,000.00 in the Economic Development category. Construction activities funded through the CDBG Program must meet one of the following National Objectives:

• Benefit to low- and moderate-income (LMI) persons;
• Prevent or eliminate slum or blight conditions; or
• Meet a need of recent origin having a particular urgency.

The types of activities for which CDBG funds may be used for include; constructing stormwater ponds, paving roads and sidewalks, installing sewer and water lines, building a community center or park, making improvements to a sewage treatment plant, and rehabilitating low-income homes. Additional information regarding the range of activities that could be funded will be provided at the public hearing.

In developing a CDBG application, the City must plan to minimize displacement of persons as a result of the activities. In addition, the City is required to develop a plan to assist displaced persons.

A public hearing to obtain citizen comment concerning the city’s economic and community development needs will be held at the (Old City Hall) Marianna City Meeting Room, 2898 Green Street, Marianna, Florida on Tuesday, February 27, 2024 at 5 p.m. CST or soon thereafter. STATE HOUSING INITIATIVES PARTNERSHIP (SHIP) and HURRICANE HOUSING RECOVERY PROGRAM (HHRP)

A Pre-Bid Conference for both new construction of stick-built homes and placement of new manufactured homes will be held on Friday, February 16th, 2024, at 9:30AM CST / 10:30AM EST at the Jackson County Administration Office, Conference Room, located at 2864 Madison Street, Marianna, Florida. Bid sheets and specifications will be available at this meeting. Bid packages will be given only to authorized representatives of construction companies attending the pre-bid conference who arrive on-time. All contractors will be pre-qualified with all license/ insurance requirements at the pre-bid conference before walk-throughs of the properties. All current licenses, liability insurance, worker’s compensation insurance/exemption, and W9 must be included in the BID package submittal. Liability insurance and all licensures must be in force at the time of the pre-bid conference. Any person claiming to be worker’s compensation exempt shall be subject to an on-the-job inspection for proof of exemption and license of all workers on job site. Certificate of Liability Insurance must have Jackson County Board of County Commissioners listed on it. It is the responsibility of the Contractor to purchase all permits deemed necessary.

After a brief meeting at the Jackson County Administration Office, group mandatory walk-throughs for the properties will be held. Any contractor not remaining with the group and failing to be present at each property within a reasonable amount of time will not be permitted to bid. On or about March 5, 2024, the City of Cottondale will submit a request to the Florida Commerce Department (COM) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to make the following improvements:

Activities:

During Hurricane Michael, the City’s sanitary sewer collection system’s sewer lines and manholes suffered direct damage and in combination with their age, resulted in severe inflow and infiltration into the sanitary sewer collection system. The large amount of rainfall resulting from Hurricane Michael saturated the ground surrounding these sanitary sewer lines resulting in joint damage and line degradation, causing sand and debris to leak into the system and wastewater/sewage to leak out into the surrounding soil. One lift station in the area was forced to far exceed its pumping capacity, due to the excessive rainfall and presence of sand and other debris, and now has been prematurely worn out.

The City of Cottondale intends to replace 2,250 linear feet of sanitary sewer collection system lines, replace ten (10) sanitary sewer collection system manholes, carry out a full rehabilitation of the damaged sanitary sewer lift station, including adding an emergency electrical generator at the lift station and replace 3,750 square yards of paving in the Southeast Sanitary Sewer Collection System Service Area. The project will result in the hardening of the sanitary sewer collection system in the Southeast Cottondale Sanitary Sewer Collection System service area. The Southeast Cottondale Sanitary Sewer System Service Area is 70% low-moderate income, so the project will provide benefit to a low-and moderate-income population.

FINDING OF NO SIGNIFICANT IMPACT
The City of Cottondale has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 2659 Front Street, Cottondale, Florida 32431, and may be examined or copied from 7:00 A.M. to 3:30 P.M. CT Monday through Friday.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Sherri McBride, City Clerk, City of Cottondale, P. O. Box 398, Cottondale, Florida 32431. Comments may also be submitted via email at [email protected]. All comments must be received by March 4, 2024. Comments will be considered prior to the City of Cottondale requesting a release of funds. Comments should specify which notice they are addressing.

RELEASE OF FUNDS
The City of Cottondale certifies to the Florida Commerce Department (COM) and HUD that James Elmore in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Cottondale to use the CDBG funds.

OBJECTIONS TO RELEASE OF FUNDS
COM will accept objections to its release of funds and the City of Cottondale certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Cottondale; (b) the City of Cottondale has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Commerce Department, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508. The Plaintiff WILLIAM BARNES, III, sues the Defendants and alleges:

  1. This is an action in equity to quiet title on real property in Jackson County, Florida, described as:

The Plaintiff WILLIAM BARNES, III., sues Defendants and alleges:

  2. The land is not divisible without prejudice to the parties.

WHEREFORE the Plaintiff WILLIAM BARNES, III., prays this Honorable Court will

  1. Pursuant to Florida Statutes 64.206, the parties may agree to a fair market value of the properties. Alternatively, the Ceurt may determine the fair market value of the properties by ordering an appraisal pursuant to subsection (4).
  2. Pursuant to Florida Statutes 64.207, there may be a co-tenant buy out.
