DESCRIPTION OF WORK
This project primarily consists of paving, drainage and utility improvements located along Smith Street beginning at SR 10 (US 90) and proceeding north to Kelson Avenue (1,030 ft) where a new roundabout will be constructed. Smith Street will be renamed Hospital Drive. New roadway construction begins at the roundabout and proceeds north across 2nd Avenue and 7th Street through the previous Golson School Campus to the intersection with Hospital Drive (900 ft). Paving improvements consist of resurfacing Smith Street from US 90 north to Kelson Avenue, reconstruction of the intersection with Kelson Avenue with a roundabout and new construction to the end of the project at Hospital Drive including earthwork, base work, drainage, curb and gutter and shoulder work. Proposed drainage improvements consist of culvert replacement and concrete drainage structures and the construction of a detention pond. The project also includes clearing/grubbing, demolition, and removal of the existing building, waterline and gravity sewer replacement, pavement markings and roadway signing. The construction cost estimated is $3,800,000.

upon payment of $125 per hard copy set which amount constitutes the cost of reproduction and handling. This payment will not be refunded. Electronic Copies of bid documents will be available free of charge. The Owner plans to open bids and publicly read aloud immediately following the bid due time, at the Marianna City Commission meeting room adjacent to City Hall.
A non-mandatory pre-bid conference will be held at the office of DHM at the address listed above at 10amCT on Thursday, June 20, 2024.
The Owner reserves the right to waive any informality or to reject any or all bids. Each Bidder must deposit with his/her bid, security in the amount, form and subject to the conditions provided in the Information for Bidders. Sureties used for obtaining bonds must appear as acceptable according to the Department of Treasury Circular 570. No bid may be withdrawn for a period of sixty days after the scheduled closing time for receipt of bids. The project includes Federal funding and is subject to Federal labor and wage requirements.
Bidders are encouraged to solicit Minority and Service-Disabled Veteran Business Enterprise participation and provide documentation of such solicitation.

Indemnification*
Public Entity Addendum

Jackson County School District, a public agency subject to Chapter 119, Florida Statutes and entitled to protection under Florida Statute 768.28.

Effective July 1, 2013, the Florida Legislature enacted §119.0701. This statute requires that all contractors who provide governmental services shall comply with Florida’s record laws with respect to services performed on behalf of Jackson County School District. Specifically, the statute requires that contractors:

i. Keep and maintain public records that ordinarily and necessarily would be required by the public agency in order to perform the service.

ii. Provide the public with access to public records on the same terms and conditions that a public agency would provide the records and at a cost that does not exceed the cost provided by Chapter 119 of the Florida Statutes or as otherwise provided by law.

iii. Ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law.

iv. Meet all requirements for retaining public records and transfer, at no cost, to the public agency all public records in possession of the contractor upon termination of the contract and destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. All records stored electronically must be provided to Jackson County School District in a format that is compatible with the information technology systems of Jackson County School District.

The failure of the Contractor to comply with the provisions set forth in this Article, if applicable, shall constitute a default and material breach of this Agreement, which may result in immediate termination, with no penalty to Jackson County School District.

Should a request be made for disclosure of confidential records of the other party, the Jackson County School District shall provide notice to the other party who may then, at its discretion, respond to the request. Should the other party not disclose the records/documents, the other party shall defend and indemnify the Jackson County School District for any fees and costs which are incurred or taxed against the Jackson County School District as a result of the non-disclosure.

Any indemnification clause notwithstanding, Jackson County School District’s liability under this Contract shall not exceed the limits set forth in Florida Statute 768.28 and no provision of this agreement shall expand those limits or remove any protection found therein.

Any dispute between the parties shall be resolved without the aid of jury (by a non-jury trial) by a judge of the 14th Judicial Circuit sitting in Jackson County Florida, applying Florida law without giving effect to any choice of law provisions.

Term of Contract
The contract resulting from this proposal shall be for a one-year period, and renewable for up to two years, beginning on or about December 1, 2024 and ending November 30, 2025 unless renewed. Either party may cancel the contract, without reason, with written notification. Cancellation must be in writing and received one hundred twenty (120) days prior to December 1 of each contract year. If renewing, an extension will be put before the School Board and must be signed by both parties prior to December 1. This condition is not to preclude providing the lowest possible price based on current economic conditions. If economic conditions warrant a change in the conditions or terms of the contract, either party may exercise the cancellation privilege on the next anniversary date without prejudice. The resulting contract from this proposal may be canceled by the Jackson County School Board, at any time, for the contractor’s failure to comply with proposal specifications. Funding for this proposal is subject to availability of appropriated funds. Invoices are to be broken down and detailed as per items listed on proposal form and will be audited for the length of this contract.

SCOPE OF WORK
The Jackson County School District is seeking the services of a School Psychologist or team of School Psychologists.
Below is the detailed Scope of Services required:
Florida State Board Education Rule 6A-4.0311, F.A.C refers to the Certification and Licensure options for providing School
Psychology services in Florida Schools. Conduct comprehensive psycho-educational assessments when requested by Multi-Tiered System of Support Team (MTSS), and/or requested by parent or school, that yield results that are intervention-oriented, that will facilitate the instruction of a student who is not responding to proven instructional and/or behavioral interventions, that will assist MTSSs in determining the student’s need for specialized instruction, and that are sensitive to the cultural background of students and families.
Prepare and type formal written psycho-educational reports that adhere to Florida Statutes and State Board of Education Rules and Jackson County and Student Services procedures for presenting evaluation and assessment data. School Psychologists working for Jackson County School Board must evaluate students and submit corresponding psychoeducational reports on or before the date requested by the Jackson County School District. Referrals may include any exceptionalities recognized by Florida Department of Education.
Psycho-educational reports will include a Full-Scale Intelligence Quotient (FSIQ) for all Intellectual Assessments unless unattainable due to lack of student response. A statement will be included in the report explaining the omission of the FSIQ in such a case. Summaries must include explanations and implications of assessments and data in the referral.
School Psychologists contracted with the Jackson County School Board will participate in Individualized Educational Plan Teams and ESE Eligibility/Placement Committees. They also assume the responsibility to maintain a valid Florida teacher’s certificate with certification in school psychology.

Applicant: The applicant for this project is Waste Management of Leon County, Inc. The applicant’s responsible official and mailing address is: Ms. Michele Lersch, Environmental Manager, Waste Management of Leon County, Inc., 4945 Highway 273, Campbellton, Florida 36426.
Facility Location: The applicant operates the existing Springhill Regional Landfill, which is located in Jackson County at 4945 Highway 273, Campbellton, Florida.
Project: The applicant applied on January 22, 2024 to the Department for a Title V air operation permit renewal. This is a renewal of Title V Air Operation Permit No. 0630045-010-AV. The existing Springhill Regional Landfill (Springhill) is a Class I municipal solid waste landfill that is owned and operated by Waste Management of Leon County, Inc. and commenced waste filling activities in 1983. Springhill has a design capacity in excess of 2.5 million megagrams (Mg) and 2.5 million cubic meters. The site’s non-methane organic compounds generation rate is calculated to be greater than 34 Mg per year. Landfill gas is collected from both the North and South Landfills and piped to the gas treatment system and then to the electric generation plant, leachate evaporator, and/or flares for combustion. Landfill gas is primarily combusted in the landfill gas to energy engines and leachate evaporator, with any excess gas routed to the flares. The electric generation plant uses landfill gas to generate approximately 5.1 megawatts of electrical power.
Permitting Authority: Applications for Title V air operation permits are subject to review in accordance with the provisions of Chapter 403, Florida Statutes (F.S.) and Chapters 62-4, 62-210 and 62-213, of the Florida Administrative Code (F.A.C.). The proposed project is not exempt from air permitting requirements and a Title V air operation permit is required to operate the facility. The Northwest District Office is the Permitting Authority responsible for making a permit determination for this project. Notice of Intent to Issue Permit: The Permitting Authority gives notice of its intent to issue a renewed Title V air operation permit to the applicant for the project described above. The applicant has provided reasonable assurance that continued operation of the existing equipment will not adversely impact air quality and that the project will comply with all appropriate provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-213, 62-296 and 62-297, F.A.C. The Permitting Authority will issue a proposed permit and subsequent final permit in accordance with the conditions of the draft permit unless a response received in accordance with the following procedures results in a different decision or a significant change of terms or conditions.
Comments: The Permitting Authority will accept written comments concerning the draft Title V air operation permit for a period of 30 days from the date of publication of the Public Notice. Written comments must be received by the close of business (5:00 p.m.), on or before the end of this 30-day period by the Permitting Authority at the above address. As part of his or her comments, any person may also request that the Permitting Authority hold a public meeting on this permitting action. If the Permitting Authority determines there is sufficient interest for a public meeting, it will publish notice of the time, date, and location in the Florida Administrative Register (FAR). If a public meeting is requested within the 30-day comment period and conducted by the Permitting Authority, any oral and written comments received during the public meeting will also be considered by the Permitting Authority. If timely received written comments or comments received at a public meeting result in a significant change to the draft permit, the Permitting Authority shall issue a revised draft permit and require, if applicable, another Public Notice. Petitions: A person whose substantial interests are affected by the proposed permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57, F.S. Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the Public Notice or receipt of a written notice, whichever occurs first. Under Section 120.60(3), F.S., however, any person who asked the Permitting Authority for notice of agency action may file a petition within 14 days of receipt of that notice, regardless of the date of publication. A petitioner shall mail a copy of the petition to the applicant at the address indicated above, at the time of filing. A petition for administrative hearing must contain the information set forth below and must be filed (received) with the Agency Clerk in the Office of General Counsel, 3900 Commonwealth Boulevard, MS 35, Tallahassee, Florida 32399-3000, Agency_Clerk@dep.state.fl.us, before the deadline. The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will be only at the approval of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C.
A petition that disputes the material facts on which the Permitting Authority’s action is based must contain the following information: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, any email address, telephone number and any facsimile number of the petitioner; the name, address, any email address, telephone number, and any facsimile number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the agency determination; (c) A statement of when and how each petitioner received notice of the agency action or proposed decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the agency’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the agency’s proposed action including an explanation of how the alleged facts relate to the specific rules or statutes; and, (g) A statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the agency to take with respect to the agency’s proposed action. A petition that does not dispute the material facts upon which the Permitting Authority’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, F.A.C.
Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Permitting Authority’s final action may be different from the position taken by it in this written notice of Intent to Issue Air Permit. Persons whose substantial interests will be affected by any such final decision of the Permitting Authority on the application have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above.
Extension of Time: Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@dep.state.fl.us, before the deadline for filing a petition for an administrative hearing. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon.
Mediation: Mediation is not available in this proceeding.
Objections: Finally, pursuant to 42 United States Code (U.S.C.) Section 7661d(b)(2), any person may petition the Administrator of the EPA within 60 days of the expiration of the Administrator’s 45-day review period as established at 42 U.S.C. Section 7661d(b)(1), to object to the issuance of any Title V air operation permit. Any petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day public comment period provided in the Public Notice, unless the petitioner demonstrates to the Administrator of the EPA that it was impracticable to raise such objections within the comment period or unless the grounds for such objection arose after the comment period. Filing of a petition with the Administrator of the EPA does not stay the effective date of any permit properly issued pursuant to the provisions of Chapter 62-213, F.A.C. REQUEST FOR RELEASE OF FUNDS
On or about June 24, 2024, the City of Marianna will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project intended to conduct citywide stormwater infrastructure rehabilitation and improvements for the repair, replacement, or construction of ditches, curb and gutter, culverts, and other drainage and conveyance structures. The proposed project activities will occur at Sunset Drive, Pebble Hill Road, Jennings Field Park, Dogwood Street, Putnam Street, Noland Street, Park Street, Wynn Street Park, Wilton Street, and College Street. Additional project activities will occur at Colonel Street, Borden Street, Cedar Street, Gilmore Road, Hospital Drive, and McPherson Street. The estimated total cost of the project is $11,195,475, CDBG-DR, DEO agreement #M0105.
FINDING OF NO SIGNIFICANT IMPACT
The City of Marianna has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City of Marianna City Hall, 2895 Jefferson Street and may be examined or copied weekdays 9:00 A.M to3:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Marianna. All comments must be received by June 21, 2024. Comments will be considered prior to the City of Marianna requesting a release of funds. Comments should specify which notice they are addressing.
RELEASE OF FUNDS
The City of Marianna certifies to the Florida Department of Economic Opportunity and HUD that William Long in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Marianna to use the CDBG funds.
OBJECTIONS TO RELEASE OF FUNDS
DEO will accept objections to its release of funds and the City of Marianna certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Marianna; (b) the City of Marianna has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. 2024 Affordable Housing Advisory Committee
The Affordable Housing Advisory Committee (AHAC) consists of voluntary local business professionals and residents of Jackson County, who actively seek ways to improve, encourage and facilitate affordable housing throughout the County. The committee is also responsible for recommending revisions or amendments to the Local Housing Plan, a plan that is updated triennially and approved by the Board of County Commissioners.
On June 11, 2024 the Board of County Commissioners appointed 9 members who are local citizens representing the residential home building industry, banking/mortgage lending industry, engaged in the labor home building, advocate for low-income persons, for profit and not-for-profit providers of affordable housing, real estate professional in connection with affordable housing, local planning committee member actively serving, citizen representing the essential services personnel industry, citizen who is an elected official, and a citizen who represents employers.
Scheduled meetings for the Affordable Housing Advisory Committee are set for the 3rd Thursday of each month beginning June 20, 2024, through October 17, 2024. Meetings will be held at 4:00 p.m. in the Jackson County Board of County Commission (BOCC) meeting room in the County Administration Building located at 2864 Madison Street, Marianna. Committee meetings will continue until the Local Housing Assistance Plan (LHAP), for 2024-2025, 2025-2026 and 2026-2027, review is complete, and recommendations are submitted to the Board of County Commissioners by December 31st, 2024. There will also be an option to attend the meetings remotely via phone or online.

The tentative upcoming 2024 schedule is as follows:
