This is to give notice that the City of Cottondale has conducted an evaluation as required by Executive Orders 11988 and 11990 in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection to determine the potential affect that the activity in the floodplain and/or wetland will have on the environment. The activity is funded by the Florida Department of Economic Opportunity (DEO) Community Development Block Grant Disaster Recovery (CDBG-DR) program under subgrant agreement number M0019.
Service Area (SA) #1 – Caney Pond Drainage Service Area:
03I Flood and Drainage: The Caney Pond Drainage Basin Service Area is a natural drainage basin. The project includes expanding the capacity of the Caney Stormwater Pond by deepening the pond, the installation of stormwater piping to carry the stormwater collected in the Caney Stormwater Pond Drainage Basin into Caney Pond, and the expansion of a discharge channel to carry the excess stormwater from Caney Pond into the DOT Stormwater Collection System along Highway 231. Caney Pond is located between Elliot Drive on the east, Caney Landing Road on the west, Broad Street on the north and Gilbert Lane on the south. Caney Pond is a naturally formed pond.
The Recipient will utilize $4,347,351.00 in CDBG-DR assistance to construct approximately 890 Linear Feet (LF) of storm drain piping and 60 LF of steel encased storm drainpipe to be installed under the railway, and will include the installation of 28 headwalls and two storm drainage piping junction boxes. Additionally, the project will excavate approximately 110,000 cubic yards from Caney Pond and approximately 31,200 cubic yards from existing channels to increase capacity of the storm water systems retention areas, which currently do not adequately provide storm water drainage during significant rain events. During significant rain events, the Caney Pond storm water drainage basin floods on a regular basis.
The Caney Pond Drainage Basin Service Area is bound by Miss Mae Lane, Hickory Street, and Pippin Drive on the North, Railroad Street on the south, the eastern end of Buttercup Lane on the east, and the rear property line of the homes on the west side of Parrish Street and Purvis Street on the west. Stormwater drainage piping improvements would be constructed along all of West Street, portions of Front Street, under the existing railroad and along existing drainage easement between Front Street to Highway 231. Between Highway 231 and Magnolia Street the stormwater would pass through an existing drainageway maintain by the Florida Department of Transportation (DOT). The stormwater would continue flowing down the existing drainageway between Magnolia Street until it entered Caney Pond. An overflow structure will be constructed at the northeast corner of Caney Pond and the overflow will continuing northward through an existing drainage channel which will be expanded, terminating in the DOT stormwater drainage piping system located within the Highway 231 right-of-way. The entire Caney Pond Drainage Basin Service Area is located in Jackson County a HUD designated most impacted and distressed County.
A portion of the activities in Service Area #1 may be carried out within a floodplain and/or wetland. Approximately 17.65 acres of land located within a 100-year floodplain and/or wetland may be included in the construction area.

These activities will have no significant impact on the environment for the following reason:
The proposed project makes improvements to an existing stormwater drainage system made up of undersized stormwater culverts, and ditches and retention areas that have over the years become filled with silt and overgrown with vegetation. Portions of this existing infrastructure reside within a wetland and 100-year floodplain as it utilizes and manages these attributes for sounder flood and drainage protections for properties within the City. The City of Cottondale has evaluated the potential of completing this project outside the wetlands and the 100-year floodplain and determined that to do so would require acquisition of additional properties to relocate to, which would increase costs well beyond budgetary constraints and would expand project timeframes to an unforeseeable completion date due to conducting acquisitions in compliance with the Uniform Relocation Act. The City also considered utilizing high-capacity pumps along with rerouting of the stormwater to outside of the areas in the 100-year floodplain and wetland areas, however, it was concluded this approach would also require the acquisition of property under the Uniform Relocation Act and the construction costs likely would be increased to substantially more than the current budget. Finally, the City considered the option of simply not moving forward with the project. This option would leave the City’s residents at continued risk for future flooding during major storms and heavy rain events.
The City concluded that while portions of the proposed project are located in the 100-year floodplain and in wetlands, the best approach to addressing the flood and drainage needs of the community, is to make improvements to the existing infrastructure as initially proposed. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 and or 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.
Although substantial portions of the project will be located in a floodplain and wetland, the City believes that the current location of the proposed improvements cannot be undertaken in any other location due to the scope of the project and the fact that the proposed scope is designed to better manage the extension and expansion of flooding and to protect properties within the city. There is, therefore, no practicable alternative than to continue with the project as proposed.
The proposed improvements conform to applicable floodplain and wetlands protection standards. The proposed action will not affect natural or beneficial floodplain and/or wetland values, and residents of the community will benefit from the project.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and or wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplains and or wetlands, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains and or wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains and or wetlands, it must inform those who may be put at greater or continued risk.

On or about December 1, 2022, the Town of Sneads will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to directly address post-Hurricane Michael economic decay by saving existing businesses and restoring an empty commercial space to bring back immediate employment opportunities and demolishing damaged and abandoned buildings. HUD funding is estimated at $951,762. The Town of Sneads has also pledged $1,000 in-kind funds toward construction costs.

SIGNIFICANT IMPACT
The Town of Sneads has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Town of Sneads Town Hall, 2028 Third Avenue and may be examined or copied weekdays 9:00 A.M to 3:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Town of Sneads Town Manager at PO Drawer 159, Sneads, FL 32460 or via email to [email protected]. RELEASE OF FUNDS
The Town of Sneads certifies to the Florida Department of Economic Opportunity and HUD that Lee Garner in his capacity as Town Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Sneads to use the CDBG funds.

The consultant will be selected by Selection Committee ranking in which consideration will be based on qualifications and experience for the type of work outlined in the scope and will strictly follow the Consultants Competitive Negotiations Act and State of Florida rules and regulations.

The administration of the estate of JOAN PATRICIA MCCUE, deceased, whose date of death was August 22, 2021, is pending in the Circuit Court for Jackson County, Florida, Probate Division, the address of which is 4445 Lafayette Street, Marianna, Florida 32446. The names and addresses of the personal representative and the personal representative’s attorney are set forth below.
All creditors of the decedent and other persons having claims or demands against decedent’s estate on whom a copy of this notice is required to be served must file their claims with this court ON OR BEFORE THE LATER OF 3 MONTHS AFTER THE TIME OF THE FIRST PUBLICATION OF THIS NOTICE OR 30 DAYS AFTER THE DATE OF SERVICE OF A COPY OF THIS NOTICE ON THEM.
All other creditors of the decedent and other persons having claims or demands against decedent’s estate must file their claims with this court WITHIN 3 MONTHS AFTER THE DATE OF THE FIRST PUBLICATION OF THIS NOTICE.
ALL CLAIMS NOT FILED WITHIN THE TIME PERIODS SET FORTH IN FLORIDA STATUTES SECTION 733.702 WILL BE FOREVER BARRED.
NOTWITHSTANDING THE TIME PERIODS SET FORTH ABOVE, ANY CLAIM FILED TWO (2) YEARS OR MORE AFTER THE DECEDENT’S DATE OF DEATH IS BARRED.
