This is to give notice that Town of Sneads has determined that the following proposed action under the Florida Department of Economic Opportunity (DEO) Community Development Block Grant Disaster Recovery (CDBG-DR) program, Stormwater Infrastructure Upgrades (Grant # M0010) is in the 100-year floodplain/wetland. The Town of Sneads will be identifying and evaluating practicable alternatives to locating the action in the floodplain/wetland and the potential impacts on the floodplain/wetland from the proposed action, as required by Executive Order 11988 and/or 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands.
The purpose of the proposed project is to conduct town-wide restoration to improve the efficiency of the stormwater system in the Town. The proposed project will occur at 15 sites around the town and shall include new drainage piping, new roadside ditches, restoration and stabilization of existing roadside ditches, stormwater management facilities, replacement of existing cross-drains, and replacement of damaged piping. Construction will occur at Keevers Road, McKeown Mill Road, River Road & Highway 90, Tanana Avenue, Pope Street, 3rd Avenue, Eugenia Street, Roseview Lane, Gorrie Avenue, Hawley Street, Hunter Drive, Oak Avenue & Adams Street, and Oneida Street. Less than 8 acres of Floodplains and less than 2 acres of Wetlands may be disturbed.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplains/wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain/wetland, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains/wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains/wetlands, it must inform those who may be put at greater or continued risk.

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Marianna.
REQUEST FOR
RELEASE OF FUNDS
On or about February 1, 2023, the City of Marianna will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to repair its citywide potable water system. The proposed project consists of constructing approximately 3,400 LF of water main to Jackson Hospital, restoration of water main along Lafayette Street from the West End Loop to Dogwood Street, and in the West End Community, State Road 276 commercial corridor, the Jackson County Sheriff’s Department facility, and the developing NextSTep Academy Autism School. The estimated total cost of the project is $7,241,760.13 which includes $50,000 of local funds toward construction costs; DEO agreement #M0101.
FINDING OF NO
SIGNIFICANT IMPACT
The City of Marianna has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City of Marianna City Hall, 2895 Jefferson Street and may be examined or copied weekdays 9:00 A.M to3:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Marianna. All comments must be received January 31, 2023. Comments will be considered prior to the City of Marianna requesting a release of funds. Comments should specify which notice they are addressing.
RELEASE OF FUNDS
The City of Marianna certifies to the Florida Department of Economic Opportunity and HUD that Jim Dean in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Marianna to use the CDBG funds.
OBJECTIONS TO
RELEASE OF FUNDS
DEO will accept objections to its release of funds and the City of Marianna certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Marianna; (b) the City of Marianna has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508. Potential objectors should contact the City of Marianna to verify the actual last day of the objection period.
